Clothing company WE Brand is notorious for its fanatical opposition to the use of letter combinations like WE, ME and HE in relation to clothes. The company recently filed a suit against Mexx, accusing it of infringing its trademark rights by using the letter combination ME + XX. However, on 31 March the District Courtof Amsterdam found against WE Brand.


No confusion
According to the ruling, WE Brand does not have a monopoly on personal pronouns. Moreover, there was no danger in this case of confusion between WE Brand’s trade marks WE and ME and the ME + XX letter combination used by Mexx. Consumers would realise that the latter was an advertisement for the well-known Mexx brand, the court concluded.
