As soon as Tentations applied for its European trademark registration, Apple filed an opposition. Apple easily demonstrated that its bitten-apple logo enjoys an enormous reputation across Europe for smartphones and software.

While Apple does not provide dating services under its logo, there is a clear connection between Apple’s smartphones and software and Tentations’ dating app. According to the opposition division of the European trademark office, consumers would easily ‘ link’ the two logos. This means Tentations would be unfairly benefiting from Apple’s the great reputation, which is not allowed, as EUIPO ruled on December 2, 2024

No Bite and Leaf

So, if you’re considering using an apple logo for your products or services, at the very least, avoid taking a bite out of it: even the smallest bite can be deadly. And it might not help your case if you add a little leaf on top either.
