Human face
When the Opposition Department of the European trademark office EUIPO assessed the matter in early November, T-Mobile was in for an unpleasant shock. EUIPO refuses to see the logo as a ‘T’: this is just a smiling human face. We don’t see a ‘T’ as much as we try. So no resemblance to the T-Mobile trademark and no infringement. The fact that Ubtech does refer to a ‘T’ with their logo as (see the entire logo) is irrelevant according to EUIPO.
