‘Mama’s’ not distinctive
The Benelux Office for Intellectual Property (BOIP) disagreed. According to the Office, the element Mama’s is not distinctive – it simply refers to food “made by mum,” and must remain free for everyone to use. Because Mama’s Soup and Mama’s Maaltijden include different visual elements and additional words, there are enough differences between them. The opposition was therefore rejected, and Mama’s Soup gets its registration.
