Limited Edition
Since 2022, the soda giant has been selling a series of limited-edition Coca-Cola flavor variants under the Coca-Cola Creations trademark. Robinsons argued that the presence of another Creations brand on the market would confuse consumers. However, the European trademark office EUIPO disagreed.
Creations Not Distinctive
The issue lies in the descriptive nature of the word Creations. According to EUIPO, “the verbal element ‘CREATIONS’ will be perceived as an indication that the beverages and beverage preparations have been crafted with a degree of creativity”. As a descriptive term, Creations is therefore not eligible for trademark protection, EUIPO ruled. Thus, Robinsons cannot use it to block Coca-Cola Creations.
