Both Sattvica and Global Royal Empire claim that Maradona, shortly before his death, granted them a license to exploit his trademark and image rights. However, EUIPO stated that it is beyond its authority to rule on the alleged licenses granted by Maradona.

Maradona Not a Famous Trademark

EUIPO only assessed whether the new figurative marks by Global Royal Empire infringe upon the Maradona wordmark. According to EUIPO, they do not. Contrary to Sattvica’s claims, the name Maradona is not considered a well-known trademark. While Maradona is undeniably a globally recognized person, this does not automatically make his name a globally recognized trademark for goods such as clothing or sports equipment. Thus, the broad protections for well-known trademarks do not apply in this case.

No Confusion

According to EUIPO, consumers may associate the figurative marks with the Maradona name, but there is no risk of confusion. Sattvica’s claim has been dismissed. It is not yet known whether Sattvica will appeal the decision.
