Philipp Plein uses the image as a logo on shirts, shoes, and bags. One might think that this is quite different from Jaguar’s cars. However, the car manufacturer succeeded in blocking Philipp Plein’s logo because of the wide recognition and strong reputation of the Jaguar logo. Well-known brands receive broad protection.
Connection
According to the Board, both logos depict “a fierce and aggressive, predatory feline.” While the products differ, consumers are still likely to associate the brands, the Board stated. It further reasoned that luxury cars, like Jaguars, symbolize status and comfort, which aligns with luxury clothing like Philipp Plein’s products. Both brands operate in the “luxury lifestyle” segment, making it easy for consumers to establish a mental link between the trademarks. As a result, Philipp Plein benefits unfairly from the strong reputation of the Jaguar trademark, which is not permitted.
