During the opposition procedure against the Business Crowns brand, manufacturer Philip Morris used a lot of evidence to illustrate the widely known Marlboro rooftop. According to EUIPO, it is clear that Business Crowns is taking unfair advantage of the distinctive character and reputation of the Marlboro trademark. That’s a no-go. The registration is rejected.
