Trademark and Copyright Infringement

According to Starbucks, Starbuds Flowers is infringing on its trademark and copyright. The coffee company is now demanding in a New York court that Starbuds immediately remove the logo, surrender all materials bearing the logo, and pay substantial damages.

Starbuds Starbucks

Starbuds Trademark?

I can’t really imagine there being any doubt about the outcome of this dispute. Putting a joint in the mouth of a globally recognized brand’s mascot and then using it to sell drugs is asking for trouble. What I do wonder is why Starbucks hasn’t acted sooner against the use of the name Starbuds in relation to marijuana. After all, you wouldn’t be able to sell drugs under the name adihash, would you?
