REGISTERED EU TRADEMARKS

If your trademarks have already been formally registered, nothing needs to be done at this time. Your European trademark will continue to be protected in 27 EU countries after 1 January 2021. For the United Kingdom, you will automatically receive a national UK trademark that is the same as your existing EU trademark.

PENDING EU TRADEMARK APPLICATIONS

Has the registration procedure for your EU trademark not yet been completed on 1 January 2021 because the trademark has recently been applied for or because an opposition is pending? In that case, the UK part of the EU trademark will not be automatically cloned, but you will have until 30 September 2021 to apply for a separate, national UK registration, which will then have the same filing date as the EU trademark.

WHAT DO YOU NEED TO DO?

The answer to the question of what you need to do now is simple: if you are a client of Chiever (and your trademarks are managed by us), there is nothing you need to do for the time being. For all our clients, we identify the possible consequences of Brexit for their EU trademark registrations and/or applications. If action needs to be taken to safeguard your rights, we will inform you of this in due time and indicate what the procedure is and what the costs are.
