August 2018. Despite the worldwide fame of Nike’s ‘swoosh’ logo, the scope of protection enjoyed even by a trademark this well-known has its limits. On 13 June, the Opposition Division of European Trademark Office EUIPO ruled in a case brought by Nike that a similar trademark filed by Swing Sense didn’t infringe the Nike logo. While the ‘body’ of the logo is practically identical to that of the Nike logo, the overall impression made by the two trademarks is different, according to EUIPO.
